Last updated: June 29, 2025

1. Introduction

Dwellafy ("we," "us," or "our") operates Dwellafy (the "Platform"). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit our website, create an account, publish or browse listings, send messages, or otherwise use the Platform.

By using the Platform, you agree to this Privacy Policy. If you do not agree, please do not use the Platform. This policy should be read together with our Terms of Service.

2. Information we collect

Information you provide

  • Account data: email address, password (handled by our authentication provider), display name, username, bio, and other profile fields you choose to add.
  • Listing data: property address and description, photos, pricing, financing terms, visibility settings, and related metadata you submit when creating or editing listings.
  • Messaging data: message content, timestamps, conversation participants, and read status.
  • Activity data: favorites, saved searches, notification preferences, and inbox settings such as starred or archived conversations.
  • Payment data: billing history, transaction identifiers, and purchase selections (such as featured placement). Payment card details are processed by our payment provider; we do not store full card numbers.
  • Support communications: information you send when contacting contact@dwellafy.com.

Information collected automatically

  • Device and browser data: IP address, browser type, operating system, device identifiers, and language settings.
  • Usage data: pages viewed, features used, referring URLs, session duration, and interaction logs.
  • Cookies and similar technologies: see Section 8 below.

Information from others

We may receive information from service providers that help us operate the Platform (for example, payment confirmation from Stripe or authentication events from our identity provider). We may also receive information if another User reports your content or account.

3. How we use information

We use personal information for the following purposes:

  • Create and manage your account and authenticate you
  • Publish, display, search, and moderate listings
  • Enable messaging between buyers and sellers
  • Process payments for Paid Features and maintain billing records
  • Send service-related notices, security alerts, and support responses
  • Personalize your experience, such as saved searches and favorites
  • Monitor, detect, and prevent fraud, abuse, and security incidents
  • Analyze usage to improve reliability and develop new features
  • Comply with legal obligations and enforce our Terms

We do not sell your personal information to third parties for their independent marketing purposes.

4. How we share information

With other users

Listing content you publish may be visible to other users and the public, depending on your settings. Messages are shared with conversation participants. Your username and profile information may appear alongside listings or messages.

With service providers

We share information with vendors that process data on our behalf under contractual obligations, including providers of:

  • Cloud hosting and database services
  • Authentication and account management
  • Payment processing (e.g., Stripe)
  • Email delivery and customer support tools
  • Analytics, monitoring, and security services

For legal and safety reasons

We may disclose information if we believe in good faith that disclosure is necessary to comply with law, respond to lawful requests, protect the rights and safety of users or the public, or investigate fraud or Terms violations.

Business transfers

If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality obligations.

5. Messages and sensitive information

Messages are intended for discussion related to listings and potential transactions. Other users may save, copy, or forward messages outside the Platform. Do not share information in messages that you are not comfortable disclosing to the recipient, including government ID numbers, full financial account credentials, or wire instructions, unless you accept that risk.

We may access messages when necessary to provide support, enforce policies, or comply with law. We do not routinely monitor all private messages.

6. Data retention

We retain personal information for as long as your account is active or as needed to provide the Platform, unless a longer retention period is required or permitted by law.

  • Account and profile data are kept while your account exists
  • Listings may remain in backups for a limited period after deletion
  • Messages and conversation metadata are retained to support inbox history and dispute resolution
  • Billing and transaction records may be kept for tax, accounting, and legal compliance
  • Logs and security records may be retained for a defined period for abuse prevention

When you delete your account from Dashboard → Account → Delete my account, we remove your profile and access. Listings you published are archived first. We delete or anonymize remaining personal information within a reasonable time, except where retention is required by law or legitimate business needs (such as fraud prevention or unresolved payment disputes).

7. Security

We implement reasonable administrative, technical, and organizational measures designed to protect personal information, including access controls, encrypted connections (HTTPS), and reliance on reputable infrastructure providers.

No method of transmission or storage is completely secure. You are responsible for safeguarding your account credentials and for using strong, unique passwords.

8. Cookies and similar technologies

We and our service providers use cookies, local storage, and similar technologies to:

  • Keep you signed in and maintain session state
  • Remember preferences and settings
  • Understand how the Platform is used
  • Protect against fraudulent or abusive activity

Most browsers allow you to block or delete cookies. If you disable cookies, some features (such as staying logged in) may not function properly. When you first visit the Platform, we show a cookie notice so you can accept essential cookies used for sign-in and session management.

9. Your choices and rights

Account settings

You may update profile information in your account settings, delete your account, and open the Stripe billing portal from Dashboard → Billing. Saved search matches trigger in-app notifications; if you configure email alerts, we may also send transactional email when a new listing matches your criteria.

Access, correction, and deletion

Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, or to receive a portable copy of certain data. Submit requests to contact@dwellafy.com. We may need to verify your identity before responding.

Marketing communications

We may send transactional emails related to your account, listings, or messages. If we send promotional emails, you may opt out using the unsubscribe link in those messages.

10. U.S. state privacy notices

Residents of certain U.S. states, including California, Colorado, Connecticut, Utah, and Virginia, may have additional rights regarding personal information, such as the right to know categories of data collected, to delete certain data, and to opt out of certain processing.

We do not sell personal information as defined by applicable state privacy laws. We do not use personal information for targeted advertising across unaffiliated websites based on cross-context behavioral tracking as a core part of the Platform.

To exercise state privacy rights, email contact@dwellafy.com with the subject line "Privacy Request." We will not discriminate against you for exercising these rights.

11. International users

The Platform is operated from the United States. If you access the Platform from outside the U.S., your information may be transferred to, stored in, and processed in the U.S. or other countries where we or our service providers operate. Those countries may have data protection laws different from those in your jurisdiction.

Where required, we rely on appropriate safeguards for international transfers, such as standard contractual clauses or equivalent mechanisms offered by our vendors.

12. Children

The Platform is not directed to children under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take steps to delete it.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may also be communicated through the Platform or by email where appropriate. Continued use after changes take effect constitutes acceptance of the updated policy.
